DATA PROCESSOR: Physical or judicial person that processes PERSONAL DATA on behalf of the DATA CONTROLLER.

DATA CONTROLLER: OGMAN TUBERÍAS INOXIDABLES S.A. de C.V., who determines the purpose and means of processing PERSONAL DATA.

ARCO RIGHTS: Rights that allow the DATA OWNER access to their PERSONAL DATA and to request a rectification of the data if it’s inaccurate, a cancellation of it if it’s considered unnecessary for the established purpose, as well as to oppose its processing for legitimate reasons.

This PRIVACY NOTICE is made available to the DATA OWNER, in compliance with the Federal Law of Protection of Personal Data Held by Private Parties, and any other applicable legal provisions.

OGMAN TUBERÍAS INOXIDABLES, is a Public Limited Company with Variable Capital legally incorporated under the laws of the Republic of Mexico and is responsible for the processing of the PERSONAL DATA of the DATA OWNER upon his granting consent to this PRIVACY NOTICE.

OGMAN TUBERÍAS INOXIDABLES, committed to complying with the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and responsibility in the processing of PERSONAL DATA, as well as the privacy and informational self-determination rights, under this PRIVACY NOTICE, states the following:

The Company will process your information and PERSONAL DATA as confidential, and will maintain preventative measures aimed at the protection against its loss, misuse, or unauthorized access, alteration or destruction, and will not disclose it for any propose other than those established in this PRIVACY NOTICE.

Your information will be processed as confidential and managed for the time needed to achieve the purposes described in this PRIVACY NOTICE, which may be updated to reflect changes in our information collection practices, use of the information, and security measures.

OGMAN TUBERÍAS INOXIDABLES, brings to your attention that the DATA OWNER’s PERSONAL DATA will be processed by OGMAN TUBERÍAS INOXIDABLES, its affiliated companies or subsidiaries, DATA PROCESSORS acting on behalf of OGMAN TUBERÍAS INOXIDABLES and/or third parties other than OGMAN TUBERÍAS INOXIDABLES or the DATA OWNER, in compliance with this PRIVACY NOTICE.

By accessing this website and accepting this PRIVACY NOTICE, as DATA OWNER, you explicitly grant OGMAN TUBERÍAS INOXIDABLES your consent to the national and international transfer of your PERSONAL DATA, provided that the recipient of the data assumes the same obligations as OGMAN TUBERÍAS INOXIDABLES. RIGHTS

In accordance with the PERSONAL DATA Protection Law, you may exercise at any time your right to access, rectify, cancel and object the processing of your information (ARCO Rights), through a written request to opina@ogmantuberias.com, who will request, for your protection and benefit, documentation to accredit the corrections to the data in case of a rectification request. You can request a cancelation of your PERSONAL DATA maintained by OGMAN TUBERÍAS INOXIDABLES by sending an email which includes the reasons for revoking consent. In addition, you can limit the use and distribution of your PERSONAL DATA in the same email.

However, the Company may be required by the applicable law to retain some or all your PERSONAL DATA. It is important that the changes you intend to make to your PERSONAL DATA are correct and the data that must be kept by the company to fulfill an obligation or legal provision will not be deleted.

All requests must be presented by the DATA OWNER or his legal representative, to the email address mentioned above and said request must include:

Full name of the DATA OWNER and physical address, or any other means of communication to receive a reply, including an email address,
Documents proving your identity or that of your legal representative,
A clear and precise description of the PERSONAL DATA that you wish to exercise rights upon,
Any other information to facilitate the localization of the DATA OWNER’s PERSONAL DATA.

OGMAN TUBERÍAS INOXIDABLES will communicate the chosen determination to the DATA OWNER within a maximum of 3 weeks after receiving the request to access, rectify, cancel or object, and changes will take effect within the next 15 calendar days. These terms may be extended double the time limit under justified circumstances and at the discretion of OGMAN TUERÍAS INOXIDABLES.

The DATA OWNER will be able to rectify his PERSONAL DATA when its inaccurate or incomplete, by indicating in the rectification request the modifications that must be made and providing OGMAN TUBERÍAS INOXIDABLES the documentation that supports the request. In case the DATA OWNER’s request is admissible, OGMAN TUBERÍAS INOXIDABLES will inform of the changes to the DATA PROCESSOR and any third parties, in case there was transfer of data under the terms of this PRIVACY NOTICE.

The right of cancellation consists of the suppression of data and may be preceded by a blocking period during which the data will not be processed. Cancellation of PERSONAL DATA will not proceed in cases provided by law.

The DATA OWNER may, at any time and for legitimate reasons, object to the processing of his data. If the request is admissible, OGMAN TUBERÍAS INOXIDABLES will cease to process the DATA OWNER’s information.

OGMAN TUBERÍAS INOXIDABLES may deny access to, rectification and cancelation of the PERSONAL DATA or the granting of opposition to its processing, when the applicant isn’t the DATA OWNER or the legal representative isn’t properly accredited, when the PERSONAL DATA of the DATA OWNER is not found in the database, when the rights of a third party may be affected, when there is a legal impediment or a pending resolution by a competent authority that restricts the access to the PERSONAL DATA or won’t allow its rectification, cancelation nor opposition, and when the rectification, cancelation or opposition has been previously made.
